These Terms and Conditions ("Terms") govern your access to and use of the Kayalogy website and platform operated from Switzerland under kayalogy.ch. By accessing or using the platform, you agree to be bound by these Terms.

1. Intended Use

Kayalogy provides a research and evaluation platform for medical artificial intelligence technologies. The platform is not a certified medical device and is not intended for clinical diagnosis, treatment, or patient management.

2. User Responsibilities

• You must use the platform only for lawful and permitted purposes.
• You are responsible for ensuring that any uploaded data is lawfully obtained and properly de-identified.
• You must not attempt to reverse-engineer, disrupt, or misuse the platform.

2.1 Account Security

If you receive login credentials, you are responsible for maintaining their confidentiality and for all activities performed under your account. Please notify us promptly of any suspected unauthorized access.

3. Data Protection & Compliance

• We process personal data in accordance with Swiss FADP and, where applicable, GDPR.
• Clinical data should be anonymized or pseudonymized before upload unless otherwise agreed in writing.
• We apply appropriate technical and organizational safeguards aligned with international security standards.

4. Intellectual Property

All software, models, documentation, and content remain the intellectual property of Kayalogy or its licensors.

5. Availability and Modifications

We may modify, suspend, or discontinue parts of the platform to improve quality, security, or compliance.

6. No Medical or Legal Advice

Content and outputs are provided for research and evaluation only and do not constitute medical or legal advice.

7. Disclaimer of Warranties

The platform is provided “as is” without warranties of any kind, to the maximum extent permitted by law.

8. Limitation of Liability

Kayalogy shall not be liable for indirect, incidental, or consequential damages arising from platform use.

9. Indemnification

You agree to indemnify Kayalogy against claims arising from misuse or violation of these Terms.

10. Termination

We may suspend or terminate access in case of misuse, security risk, or legal requirement.

11. Export Control and Sanctions

You agree to comply with all applicable export control and sanctions laws and regulations. The platform may not be used in jurisdictions subject to trade restrictions or embargoes.

12. Third-Party Services

Kayalogy may rely on third-party infrastructure and cloud providers for secure data processing and storage. We are not responsible for interruptions caused by external service providers.

13. Data Ownership

You retain ownership of your uploaded data. No transfer of ownership to Kayalogy is implied. Kayalogy retains all intellectual property rights to the platform, software, and models.

14. Amendments to Terms

Kayalogy may update these Terms from time to time to reflect changes in the platform, legal requirements, or security practices. Updated versions will be published on this page. Continued use of the platform after such changes constitutes acceptance of the revised Terms.
